Terms And Condition
1.Terms of Service
- By using the lynkboard.com service, or lynkboard.com website ("Service"), or any services of lynkboard.com, you are agreeing to be bound by the following terms and conditions ("Terms of Services"). This is a legal agreement ("Agreement") between you and Spartara Technologies, for the use of the lynkboard.com services. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity, its affiliates and all users who access our services through your account to these terms and conditions, in which case the terms "you" or "your" shall refer to such entity, its affiliates and users associated with it. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this agreement and may not use the services. The website and any downloadable software associated with the Service are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.
- Spartara Technologies reserves the right to update and change the Terms of Services from time to time without notice. Any new features that supplement or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms and Service. Continued use of the Services after any such changes shall constitute your consent to such changes.
- The failure of Spartara Technologies to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Spartara Technologies, governing your use of the Service, and superseding any prior agreements between you and Kitovu (including, but not limited to, any prior versions of the Terms of Service). You agree that these Terms of Service and your use of the Service are governed under Queensland law.
2.Payments, Refunds, Credit, Upgrading
- Additional features may be added to the Service and made available through a paid upgrade plan. If you choose to subscribe to a paid plan, you shall pay fees to Spartara Technologies. Upon selection of a paid plan, you will provide Spartara Technologies with the necessary billing information.
- All paid Account holders must enter a valid credit card for payment. Free accounts are not required to provide a credit card number. All fees are exclusive of all taxes, levies or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
- The Service is billed on a monthly basis, every 30 days, beginning on the date that you upgrade or sign up for a paid plan. As long as your Account remains active and in good standing, you will be charged the subscription fee even if you never use the service. You may, however, cancel your paid plan at any time.
If you select a paid plan, you must provide current, complete and accurate billing information. You must promptly update all billing information to keep your Account current, complete and accurate (such as a change in billing address, credit card number or credit card expiration date) and you must promptly notify Spartara Technologies if your Payment Method is changed (for example, for loss or theft) or if you become aware of a potential breach of security, such as the unauthorized disclosure or use of Your name or password. If you fail to provide any of the foregoing information, You agree that Spartara Technologies may continue charging you for any use of the paid plan under your billing information unless you have terminated your paid plan as set forth herein.
- Any upgrade from the free plan and/or any paying plan to a different paying plan level will immediately charge your credit card a prorated fee. For any downgrade in plan level, the credit card that you provided will automatically be charged the new plan amount on your next billing cycle unless you have downgraded to a free plan.
Privacy Policy
1.General Information
- We collect the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages consumers access or visit, and information volunteered by the consumer (such as survey information and/or site registrations). The information we collect is used to improve the content of our Web pages and the quality of our service, and is not shared with or sold to other organisations for commercial purposes, except to provide products or services you've requested, when we have your permission, or under the following circumstances:
- It is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Terms of Service, or as otherwise required by law.
2.Information Gathering and Usage
- When you register for lynkboard we ask for information such as your name, email address, billing address, credit card information. Members who sign up for the free account are not required to enter a credit card.
- lynkboard uses collected information for the following general purposes: products and services provision, billing, identification and authentication, services improvement, contact, and research.
3.Cookies
- A cookie is a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a web site's computers and stored on your computer's hard drive.
- Cookies are required to use the lynkboard service.
- We use cookies to record current session information, but do not use permanent cookies. You are required to re-login to your lynkboard account after a certain period of time has elapsed to protect you against others accidentally accessing your account contents.
4.Data Storage
- lynkboard uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run lynkboard. Although Spartara Technologies owns the code, databases and all rights to the lynkboard application, you retain all rights to your data and content.
5.Disclosure
- lynkboard may disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Service.
6.Changes
- lynkboard may periodically update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your lynkboard primary account holder account or by placing a prominent notice on our site. Such notice will be given at least 3 days in advance of the date the new policy will be applied.
